In his practice of law, Mr. Campbell has seen the benefits of alternative dispute resolution methods. He has represented numerous clients in both arbitration and mediation proceedings in state, national and international settings. This positive experience led him to seek and receive training as an arbitrator and a mediator, so that he might provide these services himself. He invites you to read his commentary that was published in the “IBA Compendium of Mediation Techniques”, which is listed under Publications in English, for his opinion on the state of mediation today and the means essential to make this continue to be a successful method of alternative dispute resolution.
Since 1996, he has acted as an arbitrator in his areas of practice with both the Alternative Dispute Resolution Panel and the Fee Arbitration Panel of the Alameda County Bar Association. The Fee Arbitration Panel hears fee disputes between attorneys and their clients that involve contractual and ethical disputes between the two sides. The Alternative Dispute Resolution Panel hears cases that are referred from the Alameda County Superior Court for resolution prior to trial. The vast majority of these cases are either personal injury cases or commercial and contractual disputes. Mr. Campbell has acted as sole arbitrator, panel member and chair of panel arbitrations in both binding and non-binding procedures.
Since 1998, Mr. Campbell has offered his skills as a mediator in his areas of practice through the Alternative Dispute Resolution Panel of the Alameda County Bar Association. These cases are also referred to the Alternative Dispute Resolution Panel by the Alameda County Superior Court for resolution prior to trial. Again, the vast majority of these cases are either personal injury cases or commercial and contractual disputes. Mr. Campbell has conducted dozens of mediations and has been successful in reaching a settlement in fifty percent of his cases. This does not include a number of attorneys who have told Mr. Campbell that the case settled after the mediation session and thanked him for the work that he did in bringing the parties together to make the settlement possible at a later date. In 2005, he also was listed as a mediator with the Alameda County Superior Court Probate Department’s Mediation Panel for trust, will contest and accounting matters. In this vane, he has also been appointed special master by the Alameda County Probate Court in trust & estate litigation to hear and decide matters assigned to him.
In 2003, he received an additional eight hours of mediation training through the International Bar Association, of which he is a member, and continues to update his training as a mediator on a regular basis. Mr. Campbell is available to provide his services as either an arbitrator or a mediator in his areas of practice in an effort to assist people in avoiding the expense and delay associated with the judicial system. And again, in 2009, he received a further 9 hours in mediation training with International Bar Association in his areas of practice in both civil and family law.
